MDN & The Jagged Fork Pancake 2024 Giveaway Terms and Conditions:

1. Eligibility: This giveaway is open only to legal residents of Michigan who are 18 years of age or older at the time of entry. Employees of MDN and The Jagged Fork and their immediate family members are not eligible to participate. You must have an Instagram account in order to enter to win.
2. Agreement to Rules: By participating, the entrant agrees to be fully unconditionally bound by these terms and conditions, and represents and warrants that they meet the eligibility requirements. In addition, entrants agree to accept the decisions of MDN and The Jagged Fork as final and binding as it relates to the content of this giveaway.
3. Giveaway Period: Entries will be accepted on Instagram starting on [February 3, 2024] and ending [on February 12, 2024]. All entries must be received by [February 12, 2024 at 11:59 PM, local time]. The winner will be selected on [February 13, 2024].
4. How to Enter: To enter the giveaway, participants must follow both MDN and Jagged Fork on Instagram and tag two people under the timeline post titled “JAGGED FORK GIVING AWAY FREE PANCAKES FOR A YEAR TO ONE LUCKY CUSTOMER.” No purchase is necessary to enter or win. The giveaway is only valid to enter through Instagram.
5. Prizes: The Winner of the giveaway (the “Winner”) will receive free pancakes for a year. One (1) order of pancakes per visit at any location with a restriction of 3 orders per week. No cash or other prize substitution shall be permitted. The prize is nontransferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of the Winner.
6. Winner Selection and Notification: There will be only one winner for this giveaway. The Winner will be selected by a random drawing through comments under the post titled “JAGGED FORK GIVING AWAY FREE PANCAKES FOR A YEAR TO ONE LUCKY CUSTOMER”. The Winner will be notified by [Instagram Direct Message] within 15 (15) days following selection on February 13, 2024. MDN and The Jagged Fork shall have no liability for the Winner’s failure to receive notices due to spam, junk e-mail, or other security settings or for the Winner’s provision of incorrect or otherwise non-functioning contact information. The Winner must confirm receipt of the notification and acceptance of the prize within two (2) days of notification. Failure to do so could result in forfeiture of the prize and selection of an alternate winner.
7. Rights Granted by You: By entering this content, you understand and agree that MDN and The Jagged Fork, anyone acting on behalf of MDN and The Jagged Fork, and their licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the giveaway, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent.
8. Terms & Conditions: MDN and The Jagged Fork reserve the right, in their sole discretion, to cancel, terminate, modify or suspend the giveaway should virus, bug, non-authorized human intervention, fraud, or other cause beyond their control corrupt or affect the administration, security, fairness, or proper conduct of the giveaway. We reserve the right to change the terms and conditions at any time without prior notice.
9. Limitation of Liability: By entering, You agree to release and hold harmless MDN and The Jagged Fork and their subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant’s participation in the giveaway and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment, (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service, (iv) unauthorized human intervention in any part of the entry process or the promotion, (v) electronic or human error in the administration of the promotion or the processing of entries, cancellation of game or tickets (vi).

11. Disputes: This giveaway is governed by the laws of Michigan, without respect to conflict of law doctrines.
