New Michigan Bill Would Allow Police to Use Swabs to Detect THC, Other Drugs During Traffic Stops

A new bill introduced in the Michigan House of Representatives could give police another tool for impaired drivers.

House Bill 4390, by Rep. Brian BeGole, would allow officers to use oral fluid tests—essentially a mouth swab—to check for drugs during traffic stops if there’s probable cause. The goal is to help law enforcement identify drug-impaired drivers, similar to how breath tests are used for alcohol.

Under the proposal, certified drug recognition experts could use a handheld device that can detect substances like methamphetamine, cocaine, heroin, cannabis (THC), and benzodiazepines within five minutes.

The bill is now under review by the House Government Operations Committee.
